General
No order will be deemed to constitute a contract
of sale irrespective of the manner of its transmission
to the seller, until the goods are dispatched
by the seller. Gaia's Garden reserves the right
to refuse an order.
Payment by Cheque, Credit Card or Debit Card is
due at the time of order. Please make cheques
[GBP] payable to "Gaia's Garden"
Prices
The price payable shall be that displayed at the
time of ordering. We reserve the right to change
prices at any time without prior notice.
All prices are in UK pounds. Shipping & Handling
charges are extra and are added in the Check-out
section at the following rates : Order Value up
to £9.99 = £2.50 • £10
- £19.99 = £3.00 • £20
- £39.99 = £4.50 • £40
and over = £6.50 [as of February 2010]
Delivery
If payment is by cheque, goods will not be dispatched
until payment has cleared in the seller's account.
Goods remain the property of Gaia's Garden until
fully paid for.
Orders are dispatched usually within 2 - 5 working
days. Gaia's Garden are committed to providing
an exceptional service and under normal conditions
all stock items will be delivered as promised.
Delays may at times be unavoidable due to adverse
weather, availability of stock, or other conditions
outside our control, but we will notify you of
any expected delays. If the original delivery
date cannot be met and you would rather not wait
for the goods then you will be offered the option
to cancel the order and your money will be refunded
in full.
Packaging is kept to a minimum wherever
possible and all packaging is recycled and/or
recyclable (much of it is also biodegradable).
Description of Goods
All goods are sold as described. However, due
to natural variation in some products, goods sold
may not be exactly as they are photographed i.e.
colour/shade difference and distinguishing marks
are sometimes unavoidable.
Exchanges & Refunds
Breakages, shortages or damages must be reported
to us within 3 working days of delivery.
We can not exchange herbal and aromatherapeutic
products for hygiene / health and safety reasons.
Refunds will only be given in the event of a product
being faulty and/or defective. This must be within
30 days of delivery. Goods returned must be in
the same condition as when they were dispatched.
Please note we cannot accept responsibility for
damage resulting from misuse and/or fair wear
and tear.
Returned Goods
Notification of damage of wrongly shipped goods
or incompletely shipped goods must be made within
3 days of delivery. Any claim made outside of
3 days will not be accepted.
Postage costs will not be included in the refund.
The buyer will be liable for the cost of remedying
damage to returned goods where such damage has,
in the opinion of the seller, been caused by the
goods being inadequately packaged by the buyer.
The seller's failure to insist upon strict adherence
to any of the terms and conditions with this contract
shall not be deemed a waiver of its rights within
these terms and conditions.

Liability of Gaia's Garden shall in no circumstances
exceed the original value of the price charged
